1. This Privacy Notice outlines how BBCC Development Sdn. Bhd., its subsidiaries, related corporations, associated companies, affiliates and joint venture companies as well as their representatives (collectively, “BBCC”) collect, use, disclose and process your Personal Data in respect of transactions with BBCC.

 

2. For the purpose of this Privacy Notice, the terms “we”, “our” and “us” shall refer to any company or representative within BBCC and the terms “you” and “your” shall refer to yourself and/or such other persons or companies represented by you of which you are providing Personal Data.

 

3. In this Privacy Notice, “Personal Data”, “collect”, “use”, “disclose” and “process” shall have the same meanings as defined in the Personal Data Protection Act 2010 [Act 709] (“PDPD”) (as may be amended from time to time) and its corresponding regulations, standards, guidelines, notices, and/or practices issued thereunder.

 

4. Such Personal Data which you may provide or make available to BBCC includes information concerning your personal details (such as name, identity card number, passport number, date of birth, age, gender, race, nationality), contact details and any other relevant information that you have disclosed to BBCC depending on the nature of dealings or transactions (as may be updated from time to time).

 

5. In the course of your dealing with BBCC, you may have furnished your Personal Data to BBCC  and in doing so, you acknowledge and confirm that you are providing to us accurate, complete, non-misleading and up-to-date Personal Data and further agree and consent to BBCC collecting, using, disclosing, processing and retaining your Personal Data. BBCC, its officers and employees shall not be liable for any inaccurate, incomplete, misleading or not up-to-date Personal Data provided by you.

6. In the event you furnish or make available to BBCC and Personal Data relating to a third party, e.g. information of spouse, children, parents, directors, shareholders and/or guarantors (collectively the “Relevant Persons”), you represent and warrant that you have obtained the consent of the Relevant Persons for you to provide BBCC with their Personal Data, which are accurate, complete, not misleading and up-to-date; and for BBCC to collect, use, discloses, process and retain their Personal Data for the relevant purposes.

7. Notwithstanding the foregoing, BBCC is not required to verify the accuracy and completeness of the Personal Data provided by you and BBCC is entitled to treat the Personal Data provided by you as accurate, complete, not misleading and up-to-date.

8. BBCC collects your Personal Data in various ways, in printed or electronic forms through digital and mobile platforms, such as:

• 8.1 when you / your representatives register or update an online profile or when you / your representatives complete or update your information with BBCC;
• 8.2 when you / your representative / employers submit completed form applications (including job applications) and/or documents to BBCC;
• 8.3 when you enter into any transaction with BBCC;
• 8.4 when you make payment related to any transaction with BBCC;
• 8.5 when you / your representatives communicate with BBCC employees;
• 8.6 when you visit our premises in person, e.g. sales galleries, offices or show units, through security or CCTV recordings;
• 8.7 from your personalised preference through the use of BBCC website, social media accounts, mobile platforms operated or managed by BBCC;
• 8.8 when you participate in BBCC contests, events, market research and surveys;
• 8.9 from information obtained independently by BBCC from other lawful sources; and
• 8.10 other purposes where you have provided us information.

9. BBCC may collect, use, disclose, process and retain your Personal Data for the following purposes:

• 9.1 considering and processing your application for and providing you with products and/or services of BBCC as well as products and/or services by third party service providers provided through BBCC;
• 9.2 facilitating, implementing and/or formalising any transaction with BBCC;
• 9.3 processing any payments related to any transaction with BBCC;
• 9.4 communicating with you including responding to queries, requests and/or complaints;
• 9.5 facilitating BBCC customers loyalty programmes, customer relations events and activities;
• 9.6 updating your Personal Data;
• 9.7 facilitating your participation in BBCC’s contests and events;
• 9.8 conducting market research and survey with the aim of improving BBCC’s products and/ or services;
• 9.9 *sending you marketing, advertising and promotional information about other products / services that BBCC its business partners or third-party service providers may be offering (“Marketing Information”), by way of postal mail to your address(es) and/or electronic transmission to your email address(es), text messages (SMS/MMS), telephone calls and/or other phone-based messaging to you telephone number(s);
• 9.10 conducting credit / trade checks and other background checks on you and where applicable, any Relevant Persons with any registered credit reporting agency at any time for the purposes of processing a transaction with BBCC or for as long as any dues remain unpaid any outstanding with BBCC;
• 9.11 for the purposes of credit evaluation, review or reporting and carrying out debt-collection or assisting other institutions to do so;
• 9.12 prevention and detection of crime including without limitation to money laundering, terrorism and fraud prevention, detection and prosecution;
• 9.13 required by government authorities or otherwise in compliance with laws, rules, regulations, by laws, orders, guidelines and/or directives issued by the relevant authorities;
• 9.14 enforcing BBCC’s legal rights and/or obtaining legal advice;
• 9.15 facilitating business transactions, which may include opening of utility accounts, registering ownership, and managing and maintaining of common property;
• 9.16 facilitating business transactions which may include mergers, acquisitions or asset sales;
• 9.17 compliances with internal policies and procedures, including without limitation, risk management, product planning, insurance, audit and other administrative purposes;
• 9.18 for all ancillary purposes relating to the provision of facilities including the provisions of computer, telecommunications and technology services;
• 9.19 human resources applications; and/or
• 9.20 any other incidental purposes relating to any of the above or any transaction with BBCC. *Where you have consented to receiving Marketing Information and/or sharing your Personal Data with third parties for the purposes of Marketing Information, you may opt-out of receiving such Marketing Information or sharing of your Personal Data with third parties for the aforesaid purpose by contacting BBCC in accordance with Section 15.

10. For the purposes as set out in Section 9, your Personal Data may/will be disclosed to the following parties:

• 10.1 any company or representative with BBCC;
• 10.2 BBCC third party service providers or agents (including without limitation auditors, lawyers, consultants, insurers, adjusters and utility companies);
• 10.3 any registered credit reporting agencies under the Credit Reporting Agency Act 2010 [Act 710];
• 10.4 BBCC business partners, professional advisers, investors, assignees or transferees to facilitate business asset transactions (including without limitation to any merger, acquisition or asset sale);
• 10.5 any law enforcement agencies;
• 10.6 any governmental authorities or regulatory bodies; and
• 10.7 any other party authorised and consented by BBCC.

11. BBCC may disclose your Personal Data to any or all of the parties stated above which may be located within or outside of Malaysia or involve sending your Personal Data to a location outside of Malaysia.

 

12. BBCC takes the necessary precautions, both administrative and technical, to safeguard your Personal Data against loss, theft, misuse and unauthorised access, disclosure, usage, alteration or destruction.

 

13. You may, subject to a payment of a prescribed fee, any applicable legal restrictions and/or contractual conditions, request in writing for access to a or a copy of your Personal Data.

 

14. We request that you ensure the Personal Data provided to us is accurate, complete, non-misleading and up-to-date.

16. In the event we are unable to comply with your data access request or data correction request, we will inform you accordingly by written notice.

 

17. You have an option not to provide the additional Personal Data requested by BBCC other than information indicated as necessary to facilitate the transaction. If insufficient Personal Data is provided or your consent or the consent of any Relevant Person given herein is withdrawn, or you Personal Data or the Personal Data of any Relevant Person is deleted, BBCC may not be able to continue our relationship with you, provide you with its products and services and/or fulfil any request to BBCC or you may no be able to access or use some of the functionality of our website or mobile platforms.

 

18. BBCC reserves the right to update and amend this Privacy Notice from time to any material changes will ne notified to you via the email address that you have provided or the updated Privacy Notice shall be posted on our website. Where required by applicable data protection laws we will obtain your consent to such changes.

 

19. In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Privacy Notice, the English version shall prevail.
